These Terms set the foundation for how we work together - with clarity, integrity, and shared responsibility. By using my services you agree to comply with the following terms and conditions. Please read them carefully.

These Terms apply to all services, sessions, programs, digital materials, and communications provided by Simone Foerster, Holistic Business Consulting (“Company”, “I”, “me”, “my”).

1. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering binding agreements to use this website or purchase any offering.
 

2. SCOPE OF SERVICES
All offerings, including private sessions, strategic immersions, advisory containers, and digital materials, are educational and consultative in nature.

Nothing provided constitutes medical, psychological, legal, or financial advice. You are solely responsible for your decisions, actions, and results. No representations are made regarding specific business, financial, leadership, or personal outcomes.
 

3. ASSUMPTION OF RISK
You acknowledge that you voluntarily engage in this work and assume full responsibility for your participation, implementation, and any decisions made as a result.
 

4. PURCHASES TERMS
All purchases are final. There are no refunds or reimbursements for any reason. Please review all sales pages carefully and take full responsibility for your decision before completing your booking. 5. PAYMENT TERMS
Payment is due in full at the time of booking unless a payment plan is selected.

If you choose a payment plan:

• You commit to completing all scheduled instalments.
• Instalments are processed automatically via the selected payment provider.
• Your payment schedule and billing dates are confirmed in your purchase receipt.
• You remain responsible for the full amount agreed, regardless of participation level.
• You are responsible for maintaining your billing details up-to-date.
• You are responsible for ensuring sufficient funds are available on scheduled billing dates.
• You are financially responsible for all purchases made under your name or account.
   

6. FAILED PAYMENTS
If an instalment payment fails, you will receive a notification from the payment provider with instructions to update your billing details. A second attempt will be made automatically.

If the second attempt fails:

• Access to any active services or materials will be paused.
• The outstanding balance must be resolved before access is restored.
• Continued failed payment will result in cancellation of the payment plan.
• The remaining balance will become immediately due in full.

This structure protects the integrity of my work and the mutual commitment it requires.
 

7. EARLY SETTLEMENT OF PAYMENT PLANS
You may request to settle the remaining balance of a payment plan early. Upon full payment, any future scheduled instalments will be cancelled.
 

8. RESCHEDULING POLICY
Sessions may be rescheduled up to 24 hours in advance unless otherwise stated in writing. Missed sessions or late cancellations are forfeited.
 

9. CONFIDENTIALITY
All private sessions and client communications are treated as strictly confidential. Confidentiality does not apply where disclosure is required by law, court order, regulatory obligation, or where there is a legal duty to report credible risk of serious harm to yourself or others.
 

10. INTELLECTUAL PROPERTY
All materials, frameworks, session content, written materials, recordings, and digital assets remain the intellectual property of Simone Foerster. Your purchase grants you a personal, non-transferable, non-exclusive license for your own use only.

You may not copy, reproduce, distribute, resell, share, modify, or create derivative works from any materials without prior written permission.
 

11. THIRD-PARTY SERVICES
Payments and service delivery may be processed through third-party providers including Stripe, PayPal, Zoom, Flodesk, and Tidycal. Each provider operates under its own terms and privacy policies. Simone Foerster is not liable for technical failures or data handling practices of third-party platforms.
 

12. DATA & PRIVACY
Personal information collected may include your name, email address, payment details, and any information voluntarily shared during sessions or communications.

This information is used solely to:

• Deliver purchased services
• Provide support
• Process payments
• Communicate relevant updates

A separate Privacy Policy will outline data handling practices in further detail.
 

13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, liability for any claim relating to a purchase is limited to the amount paid for the specific offering. Under no circumstances shall the Company be liable for indirect, incidental, consequential, or special damages, including but not limited to loss of revenue, business interruption, or reputational harm. You assume full responsibility for your implementation and decisions.
 

14. WARRANTIES DISCLAIMER
All services, materials, and digital content are provided as available and without warranties of any kind, express or implied, to the fullest extent permitted by law. No guarantee is made that access will be uninterrupted, error-free, or that specific outcomes will be achieved.
 

15. INDEMNIFICATION
You agree to indemnify and hold harmless Simone Foerster from any claims, liabilities, damages, losses, or expenses arising from your misuse of services, breach of these Terms, or violation of applicable law.

16. FORCE MAJEURE
Neither party shall be held liable for delay or failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, illness, technical infrastructure failures, or governmental restrictions. If such circumstances persist, obligations may be suspended or rescheduled.
 

17. TAX & VAT
All prices are listed in Euro unless otherwise stated. VAT will be applied where legally required. If you are located within the European Union and provide a valid VAT number at checkout, VAT may be reverse charged where applicable. You are responsible for any taxes applicable in your jurisdiction.
 

18. GOVERNING LAW
These Terms are governed by the laws of Germany. Any disputes shall be subject to the jurisdiction of German courts.
 

19. SEVERABILITY
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
